On June 20, 2008, the Europa-Kolleg Hamburg and the law firms Brödermann & Jahn, Graf von Westphalen Bappert & Modest, Hilbrandt Rückert Ebbinghaus, Taylor Wessing and White & Case held the 5th Hamburg Antitrust Law Symposium on the subject of “Damages Actions against Cartel Members”, the contributions to which are to be made available to the public through this volume. For completion, the relevant White Paper of the European Commission and an official joint statement of the BMWi, BMJ, BMELV and BKA have been printed in the appendices.
The current discussions on how public antitrust enforcement can be complemented by strengthened private antitrust enforcement as well as the publication of the White Paper “Damages actions for breach of EC antitrust rules” by the European Commission in April 2008 were decisive for the choice of topic. The publication of the contributions to the symposium is intended to provide suggestions for further discussion, which will not be ended by the Commission’s planned draft directive.
